NJ 5s Sweepstakes Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited by law. Subject to all federal, state and local laws. Sweepstakes begins at 12:00 p.m. Eastern Time (“ET”) on 9/03/2024 and ends at 11:59 p.m. ET on 9/13/2024 (the "Sweepstakes Period"). Sponsor's computer is the official timekeeping device for this Sweepstakes. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram.
1. Eligibility: The NJ 5s Sweepstakes (the "Sweepstakes") is open to legal U.S. residents who are 18 years or older and have a valid, public Instagram account. Employees, affiliates, and family members of the Sponsor, including their parents, subsidiaries, divisions, and agencies (collectively referred to as "Sponsor Parties"), as well as anyone living in their household, are not eligible to enter or win the Sweepstakes.
2. Sponsor: 5s MLP, LLC, 10 Hudson Yards (25th Floor), New York, NY 10001.
3. How to Enter: Entrants must follow @the5spickleball AND @majorleaguepb from their public Instagram account, and tag two (2) followers in the comments on the applicable Sweepstakes Post on @the5spickeball (the “Sweepstakes Post”) to receive one (1) Entry (“Entry”) into the Sweepstakes drawing. Entries must be received by 11:59 p.m. ET on 9/13/2024 to be eligible.
Limit one (1) Entry per person/Instagram handle. Any attempt by any entrant to obtain more than the stated number of Entries by using multiple identities or any other methods will void such Entries and entrant may be disqualified. In disputes over entrant identity, the authorized account holder of the Instagram handle used will be considered the entrant. Incomplete, late, or use of any automated systems to enter are prohibited and will result in disqualification. Proof of submission does not guarantee receipt. Normal Internet access and usage charges imposed by entrant’s online service may apply. Standard data rates may apply if entering via mobile device.
4. Winner Selection and Notification: Five (5) Winners (each, a “Winner” and collectively, “Winners”) will be randomly selected by Sponsor on or around 9/14/2024 from all eligible entries received during the Sweepstakes Period. Odds of winning will depend on the number of eligible entries received during the Sweepstakes Period. Winners will be notified via Instagram direct message and must return a completed Declaration of Eligibility and Liability Release within five days. At the sole discretion of the Sponsor, disqualification and selection of alternate Winners may occur if potential Winner: (1) fails to respond to notification by the deadline stated within such notification; (2) no response after two attempts; (3) failure to provide proof of eligibility and/or completed forms provided by Sponsor; (4) winner’s refusal to attend the Tournament; and (5) non-compliance with the Official Rules. Sponsor may, in its sole discretion, award or not award the forfeited prize to alternate Winners. Potential Winners with invalid or inactive email addresses will be disqualified. Winners are not confirmed until verification is complete. Prize details will be arranged one week after verification.
5. Prize and ARV: Winners will receive: (i) two tickets to the Major League Pickleball Tournament (the “Tournament”), and (ii) two Sponsor-branded t-shirts. The approximate retail value (the “ARV”) of the Prize is $360 USD. Winners are solely responsible for any applicable taxes, and the Sponsor is not responsible for any tax obligations.
6. Prize Restrictions: Prizes are awarded to Winners and cannot be substituted, assigned, transferred, sold, or redeemed for cash. Each Winner may select one Companion (“the Companion”) to attend the Tournament. The Sponsor reserves the right to substitute the Prize with one of equal value. The Winner is responsible for any loss or theft of the Prize once delivered, and the Sponsor will not replace lost or stolen Prizes.
The Tournament will occur from September 20 to September 22, 2024, in New York City. The specific address will be provided to Winners. The Prize does not cover travel to the Tournament or any other expenses. If the Companion is a minor, they must be the Winner's child or dependent. The Sponsor reserves the right to remove the Winner or Companion from the Tournament for inappropriate behavior or actions that could disparage or adversely affect Sponsor’s reputation, with no further obligations or compensation. The Sponsor is not liable for any legal or other costs incurred due to illegal conduct by the Winner or Companion during the Tournament.
7. General Conditions: By entering or participating in the Sweepstakes, entrants agree to be bound by these Official Rules. Sponsor’s decisions are final and BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. Sponsor Parties are not responsible for (1) any incorrect or inaccurate information or technical failures of any kind, (2) unauthorized human intervention in any part of the Sweepstakes; or (3) any other error, problem or malfunction that may occur in connection with the administration of the Sweepstakes, the processing of entries, or the selection or notification of Winner. If the Sweepstakes cannot proceed as planned due to circumstances affecting its administration, security, fairness, integrity, or proper conduct, Sponsor, in its sole discretion reserves the right to cancel, terminate, modify, or suspend the Sweepstakes. In the event of cancellation, prizes will be awarded through a random drawing from eligible entries received before the cancellation. Sponsor, in its sole discretion, reserves the right to disqualify any Entry if tampering, the use of automated Entry methods, violation of Official Rules or Instagram’s terms, or unsportsmanlike behavior is suspected.
8. Publicity. As a condition of Entry into the Sweepstakes, except where prohibited by law, each entrant, potential Winner, and Companion, by accepting the prize, grants to the Sponsor Parties, an irrevocable, worldwide, royalty-free license and right, to publicize, broadcast, display and/or otherwise use each applicable Sweepstakes entrant's name, image, likeness, city, state, and biographical material in any media now known or hereafter devised throughout the world in perpetuity for advertising and publicity purposes, without additional review, compensation, permission or approval of the applicable entrant or Winner.
9. Privacy: You agree that personal data submitted with an Entry may be collected, processed, stored, and otherwise used by Sponsor Parties to conduct and administer the Sweepstakes. You also agree that any personal data submitted by you in connection with an Entry may be used in connection with the Sponsor Parties promotional, marketing, and advertising purposes. Without limitation, Sponsor may from time to time use your personal information to send you updates on its products and services, as well as promotional materials.
10. Release and Limitations of Liability: By entering, each participant agrees to release, indemnify, and hold harmless Instagram and Sponsor Parties from any and all losses, claims, damages, liabilities, or expenses arising from their participation in the Sweepstakes, Tournament or any related activities (including, without limitation, any property loss, damage, personal injury, or death caused to any person(s)). Winners and their Companions accept full responsibility and liability for any such losses, injuries, or damages incurred as a result of participating in the Sweepstakes or using or redeeming the Prize.
11. Disputes: Entrants and their Companion agree that: (1) any disputes, claims, or causes of action related to this Sweepstakes or any Prize awarded must be resolved individually and not through class action, exclusively in the jurisdiction and venue of the courts of the State of New York; (2) any claims, judgments, or awards will be limited to actual out-of-pocket expenses incurred, including Entry costs, and will not include attorneys' fees; and (3) entrants will not be entitled to indirect, punitive, incidental, or consequential damages or any other damages beyond actual out-of-pocket expenses, nor will they be entitled to have damages multiplied or otherwise increased. All matters regarding the construction, validity, interpretation, and enforceability of these Official Rules, and the rights and obligations of the entrant and Sponsor related to the Sweepstakes, will be governed by and construed according to the laws of the State of New York, without regard to any conflicting choice of law principles that might apply the laws of another jurisdiction.
12. Official Rules and Prize Winner: To obtain a copy of these Official Rules or for the Winner requests, email the5spickleball@gmail.com with the subject line: "The NJ 5s Sweepstakes.” Requests for Winner lists must be received no later than three months after the end of the Sweepstakes Period.
